The terms “Monkaara”, monkaara.com, monkaara.co.uk, monkaara.uk, ‘us’, ‘we’ and ‘our’ refers to Monkaara. The term ‘customer’, consumer and ‘you’ refers to the user and viewer of our website.
General
Welcome to Monkaara and thank you for visiting our website. By visiting our website, you are agreeing to comply and be bound by our conditions and terms of use, which bind the relationship between us and you. If you do not wish to agree with the terms of use, please refrain from using this website. The following terms apply between you and Monkaara, when you purchase item(s) from our website, monkaara.com, or any trunk/trade shows.
Terms of Sale
You must be 18 years of age or over in order to make a purchase from our website and possess a valid credit/debit card issued by a bank acceptable to us. Monkaara reserves the right to decline any request of an order made by you. If your order is accepted, you will receive an email confirming the order with Monkaara. When you place an order with Monkaara, you are agreeing that you have provided the correct information required, and that you are the authorised user of the card that was used to make payment. You must ensure that you have sufficient funds in order to complete your purchase successfully. Insufficient funds will result in an incomplete order. When ordering from a foreign country, the price of products may fluctuate due to exchange rates at the time of purchase. All prices advertised are subject to change at any time without notice. Our products are not suitable for small or young children, so please bear this in mind when making your purchase.
Our Contract
When you make a purchase from our website, and the order has been cleared, you will receive a confirmation email receipt of your order to the email address supplied at the time of your order. Please check your junk email as sometimes confirmation orders can end up there. This is not an official acceptance of your order from Monkaara. Our acceptance of your order will only take place once your order has been dispatched. Only the goods that are listed in your confirmation of order dispatch will be sent to you. You will receive another email once your order has been dispatched.
Pricing
Whilst we endeavour to ensure that product pricing, descriptions, images and details are correct, there can be a chance error can occur. If Monkaara discover that the pricing is incorrect and an order has been placed, we will inform you as soon as possible, giving you the opportunity to re-order the order at the correct price, or cancelling your order. If we are unable to get in contact with you to regarding your order, your order will be automatically cancelled. The prices advertised for goods on our website are inclusive of VAT. Cost of delivery will be an additional charge and prices can be changed at any time in line with costs of the courier/postal company used. From time to time, we may offer discount codes either directly from our website or via third parties on full price items only. Discount codes cannot be used on sale items. You can only use one discount code per transaction. Discount codes have a time limit, and may expire at any time. Sale items are final sale.
Delivery
Monkaara aims to dispatch in stock orders within 2-3 working days. Orders will be sent to the address supplied when placing your order. In cases where the delivery address is incorrect, please notify us as soon as possible, and we try aim to change the delivery address on your order. Once orders have been dispatched, we are unable to amend the delivery address and you will not be refunded if you are unable to receive your order due to incorrect delivery address supplied. All UK orders are dispatched using Royal Mail. International orders are shipped through our courier partner. You must ensure that you are able to receive your parcel and Monkaara accept no responsibility for orders received by someone other than the customer. Once an order has been dispatched, you will become the owner for the goods sent. You must ensure you are able to receive your goods, and if your order is returned to us for whatever reason, then you may be responsible for the costs of re-delivery. We will try to contact you, however if we are unable to do so, then we will end the contract. If this is the case, then you will be refunded for the price of the goods only, and we will deduct costs for delivery.

Liability
We aim to ensure goods dispatched sent are correct, however, in the rare event that goods are defective, delayed or you receive an incorrect order, please ensure to inform us immediately by email to customercare@monkaara.com, and within 7 days of a fault arising. If Monkaara send more items than ordered, please inform us immediately so we can arrange a return of the goods. For faulty items, we will offer the option for a replacement, to have it fixed or for the item to be refunded. If goods cannot be fixed or replaced, we will issue you with a refund. Goods cannot be refunded unless they have been returned. The cost of the return of faulty goods will be placed on us. We are unable to cover costs of returns for goods outside of the UK.
If you do not receive your goods within a reasonable time frame, you must inform us with 14 days via email from the date you ordered the goods. If you fail to inform us, then we will accept no liability and will not refund you if your order has not reached you. If you do inform us within 14 days, we will either aim to resolve any shortage or non-delivery or provide you with a full refund on your order, including costs of delivery.
We will not be liable for any indirect or consequential loss, damage or expenses in a result from any of the above other than refund you only for the goods paid for by you.
We cannot guarantee that colours in our images will be rendered correctly on different computer monitors. The product dimensions supplied are intended to give an approximate indication of the size of individual products. Products shown may not be actual size. If you have any doubts about the colour, size or any other specification of the goods you wish to order, we recommend you contact us prior to placing an order on the Website at customercare@monkaara.com
We will try to make sure that the Website is always available. However, this is not always possible and access to the Website may be suspended temporarily and without notice in the case of any system failure, maintenance or repair or for any other reasons outside our control, as well as for any breach by you of these Terms & Conditions of Use.
We will not be responsible to you or any third party for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any indirect or consequential loss in connection with your use of the Website.
We remain liable however for:
- loss, damage, death or personal injury resulting from our negligence;
- fraud or fraudulent misrepresentations;
- any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982;
- defective products under the Consumer Protection Act 1987; or
- any other matter for which it would be illegal or unlawful for us to exclude or attempt to exclude our liability.

Items that are temporarily unavailable are marked Temporarily Out of Stock in their detailed view. If you would like to be informed, click on the Notify Me function or to have a product reserved for you as soon as it comes back into stock simply email us and we will ensure you are the first to know when it’s available!
Quality
Our products are carefully sourced, and some products are created in-house. We warrant that (subject to the other provisions of these terms and conditions) on delivery the Goods shall be of satisfactory quality within the meaning of the Sale of Goods Act 1979. We shall not be liable for a breach of the warranty unless: the Goods are returned to us at your expense within 7 days of the date of notifying us about a problem with your order and receiving a confirmation for your order to be returned to us. We recommend that you use recorded delivery and keep your proof of postage); and we determine in our reasonable discretion that the Goods are defective as a result of faulty materials or workmanship.
We shall not be liable for a breach of the warranty if: the defect arises because you failed to follow our verbal or written instructions as to the storage, use or maintenance of the Goods or (if there are none) good trade practice; or you alter or repair such Goods without our written consent. The items we sell are delicate and therefore care should be taken of carefully to avoid loss and damage to the goods.
All our jewellery is imitation unless otherwise stated. Due to the material of our jewellery, the colour can go off over time, therefore it is vital to ensure you take reasonable steps to ensure you take care of your goods to ensure it lasts for longer. Jewellery which is not taken of carefully can be subject to discoloration, fading, tarnishing, breaking. We will not issue refunds for goods that have not been taken of carefully. Entire Agreement

We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions. Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party´s only remedy shall be for breach of contract as provided in these terms and conditions.
